"The Implications of the Institutional Framework and the Right of Free Movement for the Mutual Recognition of Professional Qualifications"

This study analyses the mutual recognition of professional qualifications between Switzerland and the EU, looking particularly at selected health and legal professions.

The research not only examines the applicable laws between Switzerland and the EU in this context but also the case law of the Swiss courts, the CJEU and the EFTA Court for the professional recognition. To complete this analysis, the institutional mechanism, which is inherently linked to this topic, is discussed because future relations between Switzerland and the EU, as reflected in the Draft Institutional Framework Agreement, could have a large impact on the interpretation of the sectoral market access agreements. In particular, it could have an effect on the interpretation of the agreement on the free movement of persons, which refers to EU legislation on professional recognition.
